Terms of Service

These Terms of Service govern your access to and use of the W Insight service operated by W Insight Sdn Bhd ("we", "us"). By creating an account or using the service, you agree to these terms. If you don't agree, don't use the service.
1. The service
W Insight provides a TikTok ad management platform that connects to your TikTok For Business account to: (a) display performance reports, (b) automatically adjust campaign budgets based on rules you configure, and (c) track sales targets. HR / employee management tools are available on a contract-by-contract basis and are not part of any standard public tier — contact sales@winsight.com.my if interested.
2. Your account
- You must provide accurate, current information at registration.
- You are responsible for keeping your password secure. Don't share it.
- You must be authorised to act on behalf of any company or TikTok ad account you connect.
- You must be at least 18 years old.
3. Subscriptions and billing
- Paid plans are billed monthly in advance via Stripe. Past invoices are available in the Manage Plan area at any time.
- Each plan has a monthly TikTok ad spend cap. If your spend exceeds 110% of the cap, our auto-budget growth is paused (your campaigns continue running; only our automation stops). Upgrade your plan or buy extra capacity to resume.
- Each plan also includes a team seat allowance (1 / 3 / 6 / 10 login seats for Starter / Growth / Pro / Enterprise respectively). Adding users beyond your seat allowance requires either an upgrade or paid extra seats (RM 100/seat/month, prorated and charged immediately to your card on file). Disabling a user frees their seat; re-activating a previously disabled user is blocked when it would exceed your current allowance.
- Each plan also caps the number of automated campaigns (1 / 5 / 10 / 15 for Starter / Growth / Pro / Enterprise) — i.e. how many TikTok campaigns can have W Insight automation rules running simultaneously. Deactivating or deleting a campaign frees the slot. Re-activating a previously deactivated campaign is blocked when it would exceed your current allowance. Add more capacity by upgrading your plan.
- Upgrades are pro-rated — you pay the difference for the days remaining in your current period. Mid-cycle seat purchases are likewise prorated and charged immediately.
- Downgrades to a lower paid tier are not supported while your subscription is active — cancel at period end, then subscribe to the lower tier. Custom-priced contracts (e.g. Enterprise, agency-managed) cannot be self-served downgraded; please contact sales.
- Cancellation stops auto-renewal; your plan remains active until the end of the period you've already paid for. We don't issue refunds for unused days. Removing extra seats mid-cycle credits the unused portion to your next invoice.
- Prices in Malaysian Ringgit (RM), exclusive of any applicable Service Tax (SST). If we become SST-registered, the tax will be added to your invoice.
4. Acceptable use
You agree NOT to:
- Use the service for any illegal activity or to promote illegal products / services on TikTok
- Reverse-engineer, decompile, or attempt to extract source code from the service
- Resell, sublicense, or whitelabel the service without our written agreement
- Submit malicious data, attempt unauthorised access, or interfere with other users
- Use the service in a way that violates TikTok's terms of service, or to circumvent any TikTok policy
We reserve the right to suspend or terminate your account for violations, with notice where reasonable.
5. Your data and content
You retain all rights to your data, your campaigns, and any content you upload. By using the service, you grant us a limited licence to access and process your data solely to provide the service. See our Privacy Policy for details on what we collect and how we handle it.
6. TikTok integration
The service relies on TikTok's For Business API. We are not affiliated with or endorsed by TikTok. TikTok may change its API at any time, which may affect our service. We will make reasonable efforts to maintain compatibility but cannot guarantee uninterrupted access to TikTok features.
7. Service availability
We aim for high uptime but don't guarantee a specific SLA on Starter, Growth, or Pro tiers. Enterprise customers may have a written SLA. Scheduled maintenance, hosting issues, or third-party outages (Stripe, TikTok) may cause temporary disruptions. We are not liable for losses resulting from such disruptions.
8. Limitation of liability
To the fullest extent permitted by Malaysian law, our total liability to you for any claim arising from your use of the service is limited to the fees you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, consequential, or special damages — including lost ad revenue, lost profits, or business interruption — even if we were advised of the possibility.
You are responsible for your TikTok ad spending. Our auto-budget tools follow the rules you configure; we are not liable for spending decisions executed on your authorisation. Always review your TikTok dashboard regularly.
9. Termination
You can cancel your account anytime via the Manage Plan page. We may suspend or terminate accounts for non-payment, terms violations, or upon 30 days' notice for any reason. Upon termination, your access ends but we retain certain records as required by law (see Privacy Policy).
10. Governing law
These terms are governed by the laws of Malaysia. Any dispute will be resolved in the courts of Kuala Lumpur, Malaysia.
11. Changes to these terms
We may update these terms as the service evolves. The "Last updated" date at the top reflects the current version. Material changes will trigger a re-acceptance prompt at next login.
